PVH Vacation Homes: Guest Terms and Conditions

 

These Terms and Conditions ("Agreement") govern the relationship between PVH Vacation Homes L.L.C ("PVH," "we," "us," or "our") and guests ("Guest," "you," or "your") who book and stay at properties managed by PVH Vacation Homes. By booking a property with PVH Vacation Homes, you agree to be bound by these Terms and Conditions. Please read them carefully.

1. Introduction

PVH Vacation Homes L.L.C provides short-term rental accommodation services, offering a selection of privately owned properties for rent to guests. This Agreement outlines the terms under which these services are provided, the responsibilities of both PVH and the Guest, and the conditions for booking, payment, and stay. The Guest must accept and agree to these terms and conditions.

2. Services

PVH Vacation Homes offers fully furnished residential properties for temporary stay. Our services include:

  • Providing clean, well-maintained, and equipped properties as advertised.
  • Facilitating the booking process, including reservation confirmation and payment processing.
  • Providing check-in and check-out procedures.
  • Offering support during your stay for property-related issues.
  • Arranging for cleaning services before your arrival and after your departure.
  • Providing cable TV and wireless internet.

3. Host Obligations (PVH Vacation Homes)

PVH Vacation Homes commits to:

  • Ensure the property is available and in a habitable condition as described at the time of booking.
  • Provide clear instructions for check-in, check-out, and property use. If the property is equipped with a smart lock, a password and detailed instructions will be provided during check-in.
  • Respond to reasonable requests and address maintenance issues in a timely manner during your stay.
  • Maintain the privacy of Guest information in accordance with our Privacy Policy.
  • Allow scheduled viewings of the property to potential guests between 11 AM and 6 PM, with Guest presence, under the supervision of a PVH representative, as the property is listed for rental.

4. Charges and Payment

  • Pricing: All prices for properties are quoted in the local currency (AED) and are subject to change without prior notice until a booking is confirmed. Prices include applicable taxes unless otherwise stated.
  • Booking Confirmation: A booking is confirmed ONLY once the full payment of the total amount has been received from the Guest. PVH Vacation Homes reserves the right to cancel any unconfirmed booking.
  • Payment Methods: We accept various payment methods as indicated on our booking platform. All payments must be made in full by the due dates specified.
  • Security Deposit: A security deposit will be required. This deposit is intended to cover any damages to the property or its contents, excessive cleaning costs, or breaches of the house rules. The security deposit will be refunded within 5-7 business days after the property has been inspected post-departure, provided no damages or breaches have occurred.
  • Additional Charges: Guests may incur additional charges for services such as late check-out, early check-in (if not pre-arranged), excessive utility consumption (if applicable), or damages beyond normal wear and tear.

5. Termination / Cancellation

  • Guest Cancellation: Any cancellation or amendment requests must be submitted in writing (email, text, or post). The following charges will apply based on the timing of the request:
  • Cancellation by PVH Vacation Homes: If the accommodation cannot be provided for unforeseen reasons not attributable to the Company, PVH Vacation Homes reserves the right to substitute the original accommodation with another of equal or superior quality at no extra cost. In the event where an alternative is not available, a 100% refund will be issued to the Guest. PVH shall not be liable for any further compensation.
  • Breach of Terms: If the Guests violate any of the terms of this agreement, the rental period will be terminated immediately. The Guests must vacate the premises at the expiration time and date of this agreement. PVH Vacation Homes reserves the right to terminate your stay immediately without refund if you or your guests breach any of these Terms and Conditions, including but not limited to, violating house rules, causing damage, or engaging in illegal activities.

The Security deposit will not be refunded in the event of property misuse, including parties, illegal activities, and damages of the common areas.

6. Liability

  • Guest Responsibility: Guests are responsible for their own safety and the safety of their accompanying guests during their stay. Guests are liable for any damage caused to the property or its contents by themselves or their accompanying guests, whether accidental or intentional. If walls, wallpaper, or any other surfaces are damaged or stained with dark marks, the cost of repair/repaint will be deducted from the security deposit.
  • PVH Limitation of Liability: The Company is not responsible for any injury, illness, death, loss or damage sustained while on the property or using any facilities within the building. PVH Vacation Homes is not liable for uncollected items after 3 days' post-departure. The company is not responsible for any personal belongings or any missing items during the guest's stay. The Landlord is not responsible for misuse or damages caused by improper use of electrical appliances. The Company is not responsible for any inconvenience caused by failure to follow smart lock guidelines. The Company is not responsible for any complaints caused by disturbances. No refunds will be issued for issues related to internet speed, access problems, lack of knowledge of use, or personal preferences regarding cable TV and/or other internet services.
  • Force Majeure: PVH Vacation Homes shall not be liable for any failure or delay in performance under this Agreement due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, natural disasters, epidemics, or government regulations.

7. Miscellaneous

  • House Rules: Each property may have specific house rules, which will be provided to you upon booking or arrival. These rules are an integral part of this Agreement, and adherence to them is mandatory.
    • Smoking and pets of any kind are strictly prohibited. Smoking is only permitted on the balcony. Any violation of this rule will result in the forfeiture of both the rental amount and the security deposit.
    • Guests are prohibited from subletting the property or making any alterations. Guests must maintain all equipment and furnishings in good condition throughout their stay.
    • Guests must not cause any noise and/or disturbance that may disturb or annoy the neighboring property owners or guests. Any disturbance will result in immediate termination of this agreement, and the Guests must vacate the property immediately. Quiet hour starts at 10 PM.
    • Guests are not permitted to use Fireworks and other hazardous materials within or around the property.
    • The property must not be used for any illegal purposes and activities as per the UAE law. Any violations will result in immediate termination of the agreement, and guests will be responsible for legal action. No refunds will be issued for rent or deposits in such cases.
  • Occupancy: The number of Guests residing and/or sleeping in the property cannot exceed the permitted limit.
  • Check-in/Check-out: The standard check-in time is between 3 PM and 7 PM. Check-ins outside these hours are subject to availability and may incur additional charges. The standard check-out time is 12 noon.
  • Extensions: Any extension requests must be submitted at least 10 days prior to check-out. Extensions remain strictly subject to availability and the rate is subject to change. If payment is not made promptly for the extended stay, the tenant must vacate the property immediately. Last-minute extensions, on the same day as check-out, will incur cancellation charges for cleaning. Once payment for the extension is made, an email with the updated reservation will be sent to the guest.
  • Lost Personal Belongings: If any personal belongings are left behind after departure, we will attempt to contact the guest for immediate collection.
  • Governing Law and Dispute Resolution: This Agreement shall be governed by and construed in accordance with the laws of Dubai, United Arab Emirates. Any disputes or legal matters will be resolved by Dubai Tourism Police.
  • Entire Agreement: This Agreement constitutes the entire agreement between the Guest and PVH Vacation Homes regarding the subject matter herein and supersedes all prior or contemporaneous communications and proposals, whether oral or written.
  • Severability: If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Amendments to Terms and Conditions: PVH Vacation Homes L.L.C reserves the right to amend these Terms and Conditions at any time. Any changes will take effect immediately upon posting on our website or direct notification to guests. By continuing to use our services or maintaining a booking after such changes are posted, you acknowledge and agree to be bound by the revised Terms and Conditions. It is the Guest's responsibility to review these Terms and Conditions periodically for updates.

Guest Acceptance: By proceeding with a booking and staying at a PVH Vacation Homes property, you explicitly acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions and the accompanying Rental Agreement.
